Insolvency in construction: Interim certificates

Under the Housing Grants, Construction and Regeneration Act 1996 a party to a construction contract is entitled to payment by instalments and the parties are free to agree the amounts of the payments and intervals at which they become due. The resulting request for payment is made by way of issue of an “interim certificate”. This briefing considers the issues that need to be considered when there is a failure to make payment to its contractor pursuant to an interim certificate which could lead to an order for winding-up.
